General Terms and Conditions of MultiPac Montage + Verpackung GmbH
1. Contractual Partner, Scope
1.1 The purchase agreement ("Purchase Agreement") is concluded with MultiPac Montage + Verpackung GmbH, Alfred-Krupp-Str. 8, 73479 Ellwangen (Jagst) ("MultiPac").
1.2 The following general terms and conditions (GTC) apply exclusively to all orders placed by consumers and businesses via the MultiPac online shop.
1.3 MultiPac hereby expressly rejects any counter-confirmations, counter-offers, or references made by the contractual partner to their terms and conditions. Deviating terms only apply if expressly confirmed in writing by MultiPac.
1.4 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activities. A business is a natural or legal person or a partnership with legal capacity that acts in the execution of its commercial or independent professional activities when concluding a legal transaction.
1.5 For businesses, these GTC also apply to future business relationships without the need for MultiPac to refer to them again.
2. Contractual Partner, Conclusion of Contract
2.1 The presentation of products in MultiPac’s online shop does not constitute a legally binding offer but an invitation to submit an order. You can place MultiPac products in your cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided in the ordering process. By clicking the order button, you submit a binding order for the items in your cart. Confirmation of receipt of your order is sent immediately after submitting via an automated email. MultiPac will review your order and confirm the conclusion of the purchase agreement through a separate email. Upon this confirmation email, the purchase agreement between you and MultiPac is concluded.
2.2 The languages available for concluding the contract are German and English.
2.3 MultiPac stores the contract text and sends you the order details and applicable GTC via email. You can view and download the GTC at any time on this page. Your past orders can be viewed in the customer login section of MultiPac’s online shop.
3. Delivery Conditions
3.1 In addition to the product prices indicated, shipping costs apply. You can find more information on shipping costs in the respective offers.
3.2 MultiPac only delivers via shipping. Self-collection of goods is unfortunately not possible.
4. Payment
The following payment methods are available in the MultiPac online shop:
4.1 Credit Card
Your credit card will be charged upon completion of the order. No fees are charged by MultiPac for choosing this payment method.
4.2 PayPal
You pay the invoice amount via the online provider PayPal. You must generally be registered there or register first, authenticate with your login credentials, and confirm the payment instruction to us. Further information is provided during the ordering process. MultiPac does not charge fees for selecting PayPal or PayPal Express.
4.3 Invoice
Available only for business customers who have already been supplied by MultiPac.
4.4 SOFORT Bank Transfer
MultiPac also offers SOFORT Bank Transfer. MultiPac receives the payment confirmation immediately, speeding up the entire ordering process. You only need your account number, bank code, PIN, and TAN. Through SOFORT GmbH’s secure and merchant-inaccessible payment form, an immediate transfer is initiated from your online bank account. The purchase amount is immediately transferred to MultiPac’s bank account. At the end of the ordering process, a pre-filled form opens, showing MultiPac’s bank details, the transfer amount, and the payment reference. You select your country, enter your bank code, and log in with your online banking details. Confirm your payment by entering the TAN. The transaction is confirmed immediately afterward. Generally, any internet user with an online banking account that supports PIN/TAN procedures can use SOFORT Bank Transfer. Please note that some banks do not yet support this service. You can check compatibility here:
No fees are charged by MultiPac for choosing SOFORT Bank Transfer.
4.5 Amazon Pay
With Amazon Pay, you use the payment and shipping information stored in your Amazon account. You only need your Amazon login details. You must generally be registered with Amazon or register first, authenticate with your credentials, and confirm the payment instruction to MultiPac. Additional instructions on accessing the provider’s site are provided during the ordering process. No fees are charged by MultiPac for choosing Amazon Pay.
4.6 Klarna Invoice
In cooperation with Klarna, MultiPac offers the option to pay via invoice. When paying with Klarna, you never have to provide your account details and pay only after receiving the goods. Delivery to an address different from the billing address is not possible with Klarna invoice options. Both must match your registered address. Our claim is assigned to Klarna AB, and you may only pay Klarna AB with debt-discharging effect. Further details can be found here:
No fees are charged by MultiPac for choosing Klarna Invoice.
5. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal, as described in the withdrawal policy. Businesses are not granted a voluntary right of withdrawal.
6. Retention of Ownership
6.1 The goods remain the property of MultiPac until full payment is made.
6.2 For businesses, the following additional terms apply: MultiPac retains ownership of the goods until all claims arising from the ongoing business relationship have been settled in full. You may resell the goods in the ordinary course of business; all claims resulting from such resale are assigned to MultiPac in advance, regardless of whether the goods are combined or mixed with new items. MultiPac accepts this assignment. You remain authorized to collect the claims, but MultiPac may also collect claims if you fail to meet your payment obligations.
7. Transport Damages
7.1 For Consumers:
If goods are delivered with obvious transport damages, please report such defects to the carrier immediately and contact MultiPac without delay. Failure to report or contact us does not affect your legal rights or their enforcement, especially your warranty rights. However, you help MultiPac assert its claims against the carrier or transport insurer.
7.2 For Businesses:
The risk of accidental loss or deterioration passes to you as soon as MultiPac delivers the item to the carrier, freight forwarder, or other person or institution designated to carry out the shipment. For merchants, the obligations under Section 377 of the German Commercial Code (HGB) apply. If you fail to report defects as required, the goods are deemed approved unless the defect was not detectable during the inspection. This does not apply if MultiPac fraudulently concealed the defect.
8. Warranty and Guarantees
8.1 Unless explicitly stated otherwise below, the statutory defect liability law applies.
8.2 For Consumers:
The limitation period for defect claims for used goods is one (1) year from the date of delivery.
8.3 For Businesses:
The limitation period for defect claims is one (1) year from the transfer of risk. The statutory limitation periods for recourse claims under Section 478 BGB remain unaffected.
8.4 Agreements on the quality of goods apply only to MultiPac's own statements and the manufacturer’s product descriptions explicitly included in the contract. Public statements by the manufacturer or other advertising do not constitute a warranty.
8.5 If the delivered goods are defective, MultiPac will initially provide a warranty to businesses at its discretion by rectifying the defect (repair) or delivering defect-free goods (replacement).
8.6 The above limitations and shortened periods do not apply to claims for damages caused by MultiPac, its legal representatives, or vicarious agents:
- In cases of injury to life, body, or health;
- In cases of intentional or grossly negligent breach of duty and fraud;
- In cases of breach of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations);
- Under any agreed warranty;
- To the extent the scope of the Product Liability Act is opened.
8.7 Information on any additional guarantees and their exact conditions can be found with the product and on special information pages in the shop.
9. Liability
9.1 MultiPac is always liable without limitation for claims based on damages caused by MultiPac, its legal representatives, or vicarious agents:
- In cases of injury to life, body, or health;
- In cases of intentional or grossly negligent breach of duty;
- Under warranty promises, if agreed;
- To the extent the scope of the Product Liability Act is opened.
9.2 For the breach of essential contractual obligations whose fulfillment is necessary for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), MultiPac is liable for slight negligence limited to the foreseeable damage typical for the contract at the time of conclusion.
9.3 Damage claims for apparent defects in delivered goods are excluded for merchants unless the defect is reported within two (2) weeks of delivery.
9.4 Further claims for damages are excluded.
